You might not know who Nikki Benz is - or at least, you might claim not to - but she might just be on the cusp of setting a major legal precedent in the United States.

Benz (real name Alla Montchak) is an adult film star, and has announced a lawsuit against a major porn production company, claiming $5 million (£3.5 million) in damages after an alleged sexual assault that occurred during a film shoot.

The target of the suit is the film production company Brazzers, as well as director Tony T and Benz's co-star, Ramon Nomar.

Benz alleges that she was assaulted in December 2016 in the production of an unscripted scene, in which she claims that she was stomped on, thrown against a wall, choked with her underwear, had water poured down her throat and struck so hard that she bled.

She also claims that her co-star continued to have sex with her despite her shouting 'cut' and asking him to stop.

Benz contends that she was never told what would happen in the scene and that she never consented to be touched by the director, Tony T.

What's more, Benz claims that she was forced to say on camera that she would work Tony T again, on pain of her fee for the shoot being withheld. She initially made allegations against Tony T in 2016, which resulted in Brazzers, one of the biggest names in the adult film industry, cutting all ties with him.

"I guess rape scenes are in now huh?" Benz posted on social media at the time of the incident.

"On set bullying, rape, & violence should never happen. #NoMeansNo on camera, off camera. Just NO!"

She added: "The director himself put his hands on me and was choking me. Never in a million years did I think Brazzers would allow it."

Brazzers released a statement at the time, clarifying their position.

It read: "We have become aware of a controversy surrounding a recent shoot involving Nikki Benz. As most of you already know, we do not produce content ourselves but commission producers to do so on our behalf.

"We understand that this particular scene was an unscripted scene with the artistic direction left open to the producer's discretion.

"Brazzers does not condone nor does it tolerate conduct by producers that would jeopardize a performer's security or well-being.

"Given the allegations surrounding the production of this scene, Brazzers will thoroughly investigate its production, and, if necessary will take steps that are reasonably calculated to prevent the alleged behaviour from occurring."

Benz rejected the statement, posting a screenshot of a text conversation that claims from a witness that she said cut and they continued filming.

Brazzers then released a further statement that seemed to corroborate some of the events.

"It appears that some of the alleged conduct could have occurred, and we took immediate measure to sever our relationship with the producer in question," the statement read, firing Tony T.

"Not only have we terminated all existing professional engagements with the producer, but any possibility for any future endeavors with this producer have also been quashed."

The lawsuit is for 'pain, suffering, emotional distress, as well as past and future medical expenses and lost wages', and will now go to the Los Angeles Superior Court.
