A judge has ordered a woman in New Jersey to tear down 'vulgar' anti-Joe Biden and pro-Donald Trump flags from her home.

Roselle Park resident Andrea Dick has attracted a lot of attention for her public displays of hatred towards the current administration.

One flag shows Donald Trump holding two middle fingers up with the phrase 'F**k Biden', while another says 'F**k Biden Not My President'.

The attention grew to such a level that Ms Dick started getting complaints and requests for her to taken them down.

She refused and the matter made its way to court.

According to NJ.com, the resident said she was well within her First Amendment rights to express her political opinion.

"I'm not taking them down," Dick said. "I refuse to take them down... today I got a phone call from code enforcement... I said nothing against you, but I'm not taking them down.

"I said I have a right, freedom of speech, and I'm leaving them up there."

However, people campaigning for the flag removal say it has nothing to do with freedom of speech and simply comes down to vulgarity.

Mayor Joseph Signorello said: "It's been brought to our attention less because of the political aspect of it, but the vulgarity of it.

"The real problem is, from a neighbour perspective, is it's a block away from an elementary school. It's in a high visibility area for children. Most of the ire was drawn from a lot of local parents."

But Ms Dick's attorney has likened the campaign to something out of Nazi Germany.

Lawyer Michael Campagna said democracy is all about letting people speak their minds, even if you don't agree with it.

"In Nazi Germany, when Hitler didn't like something, they burned the books and then they burned the people," he said. "I don't think we want that to happen in Roselle Park."

But, Roselle Park Municipal Court Judge Gary Bundy didn't agree with the comparison and has upheld the order to have the flags removed.

He said Ms Dick is well within her rights to boast about her political affiliations, however she has to do it in a respectful way.

"This ordinance does not restrict political speech. Neither this town or its laws may abridge or eliminate Ms. Dilascio's freedom of speech," he said in court.

"However, freedom of speech is not simply an absolute right.

"It is clear from state law and statutes that we cannot simply put up the umbrella of the First Amendment and say everything and anything is protected speech."

He's threatened to fine Andrea $250 every day she keeps the flags up.
