A day after Tesla was cautioned by health officials against reopening its California car factor, CEO Elon Musk has said that the company is going to move its headquarters out of the state.

The entrepreneurial billionaire has also tweeted to say that Tesla would be filing a lawsuit against Alameda County 'immediately' as this move is 'the final straw'.

This comes as the 48-year-old attempts to reopen the factory for 'limited operations' with plans to bring back around 30 percent of the workforce, according to The Verge.

In one of a series of tweets earlier today, Musk said that the company would be filing the lawsuit before going on to write: "Frankly, this is the final straw. Tesla will now move its HQ and future programs to Texas/Nevada immediately. If we even retain Fremont manufacturing activity at all, it will be dependen [dependent] on how Tesla is treated in the future. Tesla is the last carmaker left in CA."

In another tweet he went on to say: "San Joaquin County, right next door to Alameda, has been sensible & reasonable, whereas Alameda has been irrational & detached from reality. Our castings foundry and other faculties in San Joaquin have been working 24/7 this entire time with no ill effects. Same with Giga Nevada."

Reports confirm that Alameda County is still under a shelter-in-place order and that Telsa didn't meet its criteria to reopen.

According to Bloomberg, Erica Pan, Alameda County's health officer explained: "We have not said that it's appropriate to move forward".

The county said in an emailed statement that it informed the company it didn't meet criteria to reopen.
