When two people are caught having sex in the bogs, it usually involves some rank portaloo or claustrophobic toilet on a plane. Not for these two men, who were caught having sex in the House of Fraser loos at Nottingham's intu Victoria Centre. Classy. Well, kinda.

Gerry Joyce and Charles Lowe - 68 and 73-years-old, respectively - were found in the toilets at 10.20am by a security guard after a female shop worker grew suspicious about what was going on in there and asked someone to check it out.

According to Prosecutor Lee Shepherd, the security guard "went into the toilets and saw them stood next to each other at the sinks. One had his trousers lowered."

The other man was performing a sex act on him. After being caught by the security guard, the pensioner with his kecks down then "quickly pulled up his trousers", the Metro reports.

The men, who didn't know each other, admitted sexual activity in a public lavatory and were each fined £235 ($314). They've also been banned not only from the intu Victoria Centre, but also intu Broadmarsh Centre and intu Derby.

This wasn't a first offence for the men, either. Lowe was last in court for 1979 for gross indecency, according to Mr Shepherd, and after appearing in the crown court three years ago for indecent exposure, Joyce has now been ordered to attend a sex offences group work programme.

Paul McLeod, defending Lowe, said he is bisexual and that the two offenders didn't know each other. He also said that the situation has "left him very embarrassed. It was too much and he has been in a psychiatric unit since.

"He has been released to come to court and will go back when a decision will have to be made in terms of what is going on with him. If he is to be discharged, one of the things will be counselling."

Defending Joyce, Richard Hetherington said that he is straight, and did not know House of Fraser toilets to be notorious for people wanting to have sex, adding that Joyce had been 'candid in a police interview'.

"There is no suggestion of distress caused to anyone," Hetherington said.

Presiding magistrate Marion Smalley told the men that the offence was 'blatant' as it took place in a public area of the toilets.

"The offence has attracted a large amount of publicity, causing you both embarrassment," Smalley added.
