
A road rage killer will be resentenced after an appeals court tossed out his sentence due to the 'fundamentally unfair' use of an AI video during his trial.
Gabriel Horcasitas had received a 10-and-a-half-year custodial sentence after shooting and killing Christopher Pelkey during a 2021 road rage confrontation. According to court documents from the case, Horcasitas had fatally shot the 37-year-old after he got out of his truck and approached his vehicle.
However, the 54-year-old will now be re-sentenced after a successful appeal by his legal team, who argued against the decision by Pelkey's family to use an AI-generated video of him addressing Horcasitas.
In the ruling, the Arizona Court of Appeals concluded that showing the video, which showed Pelkey suggesting that he and Horcasitas could've been friends in a different scenario, was a 'fundamental error' on the defence's part and led to a 'prejudiced' sentence.

What did the AI video of Christopher Pelkey say?
The video featured an artificially generated version of Pelkey, created using his voice and likeness, addressing the court before sharing his spiritual beliefs. The clip begins with 'Pelkey' stating that he is a 'version of Chris Pelkey recreated through AI' and that he wanted to make his own victim impact statement.
The AI recreation of Pelkey begins by addressing Horcasitas, saying, 'It is a shame we encountered each other that day in those circumstances. In another life, we probably could've been friends'.
'Pelkey' then goes on to share his spiritual beliefs, saying that he believes in forgiveness before talking about how he won't be able to grow older due to his killing.

"Thank you to everyone for being here," the AI Pelkey concludes.
According to a report from the BBC, presiding Judge Todd Lang told the court that he had 'loved' the video.
"I loved that AI, thank you for that. As angry as you are, as justifiably angry as the family is, I heard the forgiveness," he said. "I feel that that was genuine."
It was previously revealed that Pelkey's sister, Stacey Wales, had penned the script for the video, telling AZFamily that she'd wanted her brother to 'speak' at the sentencing.

Why was the sentence overturned?
According to documents from the appeal, the court notes that while the real video footage of Pelkey was permissible, the AI video had led to Horcasitas receiving a 'fundamentally unfair' sentence.
"Accordingly, we vacate the sentence for manslaughter and remand for resentencing," the document adds.
Horcasitas' conviction for manslaughter was upheld, with his resentencing to take place at a later date.
