New smoking rules in full as lifetime ban for people born after 2008 officially passed as law

It's hoped the Tobacco and Vapes Bill will create a 'smoke-free generation'

Anyone born on or after 1 January 2009 will never be able to legally purchase cigarettes, as the Tobacco and Vapes Bill is set to become law.

Today (29 April), it was confirmed that the bill had been given Royal Assent, meaning that children aged 17 or younger are permanently banned from purchasing all tobacco products; this includes cigarettes, cigars, and shisha.

"This legislation marks a turning point for the nation’s health," Wes Streeting, Secretary of State for Health and Social Care, said of the news.

"By ending the cycle of tobacco addiction for future generations, we are taking one of the boldest steps in decades to prevent illness before it even begins.

"A smoke-free generation is now within reach, and this government is determined to deliver a healthier, fairer future for everyone."

It's believed the bill will come into force from 1 January, 2027.

What is included in the Tobacco and Vapes Bill?

Generational smoking ban

The main part of the new bill is the implementation of a generational smoking bill, which means that anyone born on or after 1 January 2009 will never be able to purchase any tobacco-related product, regardless of their age.

Eventually, the law will lead to smoking being completely illegal across the country for everyone.

Smoking remains the leading cause of preventable death in the UK, causing approximately 74,600 to 78,000 deaths per year, and it's hoped the law will lead to a decrease in these figures.

The legislation is the first of its kind in Europe.

Restrictions on vapes

Restrictions around tobacco products aren't the only thing which is changing under the new law, as it will also impact vaping.

Under the new law, it will be illegal to sell vapes, nicotine pouches and non-nicotine vapes to people under the age of 18.

Vaping bans will also be extended across more public areas, with the new legislation including playgrounds, outside schools and inside hospitals.

Drivers will also be banned from vaping inside cars if they're carrying child passengers.

Retail restrictions

Retailers selling cigarettes, vapes and related products will be required to have a license to stock, advertise and sell these products.

There will be restrictions on vape flavours and packaging, in order to make it less appealing to young people.

Strict penalties will also be brought in for shops which are found not to be complying with the rules, including penalties of up to £2,500.
