Mum charged after allegedly sleeping with two adopted sons as disturbing text messages shared

The teacher has been charged with incest, she has pleaded not guilty

A teacher and mother of six has been charged with incest after she was arrested for allegedly sleeping with two of her adopted sons.

According to a statement from Pend Oreille County Sheriff’s Office, 35-year-old American woman Amber Swain was arrested on suspicion of first-degree incest and second-degree incest on 2 June.

Last month they had been contacted by the Department of Children Youth and Families (DCYF) to alert them to the possibility that two teenagers may have been sexually abused.

Following up on the allegations, police interviewed the boys and spoke to Swain, with deputies deciding 'there was probable cause to believe the incidents occurred', and Swain was taken into custody and subsequently charged.

At an arraignment on 8 June she pleaded not guilty, and her trial is set to start on 6 October.

Since then she has been in Pend Oreille County Jail and has been placed on administrative leave from her teaching job at Pend Oreille River School.

According to the Daily Mail, the allegations were first raised with the DCYF by Swain's husband Daniel, the two are separated, who informed them of his suspicion about her relationship with the adopted boys who are now aged 17 and 18.

Court documents contain alleged text messages supplied by Daniel to the authorities which appear to show one of the woman's adopted sons saying he wanted to sleep in her bed 'again' and asking if it could happen 'just once', with her saying 'no' and turning him down.

She then allegedly wrote: "Nothing like that is ever going to happen. You will find someone who you love being with like that and care about."

During police interviews one of the boys said he'd had sex with his adopted mother 'many times'.

One of the adopted boys claimed to police that he fell asleep in her bed and woke up to her getting in with him, alleging that 'things got handsy' afterwards before she told him they couldn't continue.

Swain had denied the allegation when asked about it by police, claiming her adopted son had touched her leg and she moved away, then told officers she 'leaned in' when she was 'half asleep'.

An affidavit says she initially denied having sex with the other boy, then claimed she had sex with him in February this year.

Police told her that the boy, who is now 18 and has a birthday in January, had claimed to them it had started in December when he would have been 17.

First degree incest carries a prison sentence of up to 10 years and a $20,000 fine.
