Stephen Bear's fiancee Jessica could face jail time after filming video inside prison

Stephen Bear's fiancée Jessica Smith has put herself in jeopardy of facing time in prison as a result of posting a video to TikTok

Stephen Bear's fiancée Jessica Smith has put herself in jeopardy of facing time in prison as a result of posting a video to TikTok.

On 13 December, 2022, reality star Stephen Bear was convicted of voyeurism under the Sexual Offences Act 2003, before later being sentenced on 3 March, 2023 to 21 months in prison.

His fiancée, Jessica Smith has since been to visit him in prison, however, she could now face imprisonment herself as a result of sharing footage on social media from inside the facility.

In a video posted to TikTok, Smith invites followers to: "Come with me on a visit to see my boyf."

The footage shows Smith putting the kettle on, before feeding her dogs, brushing her teeth, having a shower, putting on an outfit and performing a 'fit check' so she can 'look cute' for Bear.

Smith then shows the outside of the visitors waiting area, before recording herself having 'checked in' with her HMP wristband on.

The last clip of the montage reads: "So good to see him but sad cos I can't see him for another two weeks."

The video has amassed over 600,000 views and 12,000 likes, but was it worth it?

Smith could now find herself in a similar position to Bear and face time in jail herself - with it being an offence to take a photograph or recording inside a prison.

Section F1 40D of the Prison Act 1952 states 'other offences relating to prison security' include: "A person who, without authorisation:

"(a) takes a photograph, or makes a sound-recording, inside a prison, or

"(b)transmits, or causes to be transmitted, any image [F2, sound or information] from inside a prison by electronic communications for simultaneous reception outside the prison - is guilty of an offence."

In section F4 part 5, the act continues that if a person is found guilty of 'an offence under this section' they may be liable 'on conviction on indictment, to imprisonment for a term not exceeding two years or to a fine (or both)' or 'on summary conviction, to imprisonment for a term not exceeding [F5 the general limit in a magistrates’ court] or to a fine not exceeding the statutory maximum (or both)'.

While it's not yet been revealed if Smith will face punishment for her TikTok video, Bear remains in prison for 21 months, having also been handed a five-year restraining order that bans him from going near ex-partner Love Islander Georgia Louise Harrison.

Bear has also been placed on the Sex Offenders Register for 10 years.
