Fresh twist in case after model is sued by ex-NFL star husband over ‘penis size’ comment

Haley Baylee is hoping that a technicality could help get her off the hook after she was sued by her former husband, NFL star Matt Kalil.

The model, 33, landed herself in some legal trouble after making a comment about the alleged size of the sportsman's penis.

She claimed that measurements of Kalil's manhood were the 'biggest factor' in their divorce in 2022 and alleged that it made sex 'impossible'.

According to Baylee, the former football player is packing some serious heat.

During a Twitch live stream with popular content creator Marlon Garcia in November last year, she compared his penis to 'two Coke cans on top of each other, maybe even a third'.

After her remark went viral, Baylee - who got hitched to Kalil in 2015 before they divorced due to 'irreconcilable differences' - shared a statement claiming the 'funny soundbite' had been blown out of proportion.

"I care deeply about respecting his privacy and the integrity of what we shared together," she said of her former husband. "During our livestream, we talked about so much more than what’s being highlighted the love in our marriage, the growth we experienced, the depth of our connection.

“It’s unfortunate that only one fragment is being amplified, because it doesn’t capture the full story of how meaningful things were to me."

Kalil seemingly didn't take the comment as a compliment, though, as the 36-year-old filed a lawsuit against her about her alleged 'invasive commentary' about his manhood.

The former offensive tackle, who played for teams such as the Minnesota Vikings, Carolina Panthers and Houston Texans, has since moved on from Baylee with another model, Keilani Asmus. The couple tied the knot in April 2024, before welcoming a son later that year.

In his lawsuit, Kalil claims that Baylee received 'substantial financial benefit, increased viewership, increased engagement, and monetisation through various social media platforms and media coverage' after making the comment about his penis.

He is seeking a jury trial where he hopes to earn more than $75,000 in damages.

However, Baylee is battling to get the case thrown out of court - and she reportedly hopes that a judge will toss out Kalil's lawsuit as she didn't outright state his name.

Legal documents obtained by TMZ are alleged to show how the former Sports Illustrated Swimsuit model is arguing that she did not mention the name of the person whose penis she was discussing on the livestream.

Rebuffing her ex-husband's claims that 'viewers could and did readily infer' who she was talking about, Baylee has reportedly insisted that this was down to the fact that both of them are prominent public figures instead.

Previously, Baylee's legal team explained they intended to file a motion arguing that her having 'erotic autonomy' - AKA, the right to make her own choices about her own body and sexual experiences - granted her the right to discuss her past sex life.

Her lawyer Matthew Bialick previously said his client was simply 'exercising her sexual sovereignty by truthfully describing a sexual experience that left her in tears'.

He claimed that banning her from doing so would violate her right to free speech.

In the wake of the latest twist, Bialick told TMZ: "A woman’s right to provide a truthful account of her own relationships and her own past sexual trauma lies at the very core of First Amendment protections.

"Mr. Kalil’s brief mentioned the First Amendment a grand total of three times and offered no constitutional analysis whatsoever.

"We are more confident than ever that this case will be dismissed and that Ms. Kalil will be awarded her attorneys’ fees."

A judge has not yet ruled on whether Kalil's lawsuit will be dismissed.
